Constitution and by – Laws of

Barucboc National High School Employees Association

Preamble

            We, the members of the Barucboc National High School Employees Association (BNHSEA), imploring the aid of Almighty God in our common desire and aspiration, to be a tool for quality education in the development of the youth as future leaders of the nation and to foster a friendly working relationship, professional competence, and leadership excellence do hereby bind ourselves into an association dedicated to the progressive pursuit of the school’s vision – mission and therefore promulgated this Constitution and by – Laws.

Article I

Name, Seal and Office

Section 1. The name of the Association shall be Barucboc National High School Employees Association.

Section  2. The seal of the Association shall be_______________________________________.

Section 3. The office of Barucboc National High School Employees Association (BNHSEA)  shall be any space inside the premises of the school.  

Article II

Declaration of Principles and Objectives

Section1. The BNHSEA  is an independent association of teaching and non- teaching, who shall promote mutual understanding through social, civic, intellectual, recreational and scientific programs and activities.

Section 2.The Association shall have the following objectives:

            2.1. To advance the cause of quality secondary education.

            2.2. To promote among the members the professional competence, good working environment and instructional leadership excellence.

            2.3. To help uplift the educational attainment of poor but determined to succeed students through financial assistance.

            2.4. To give financial assistance to beneficiaries of legitimate members in times of death and hospitalization of the members.

            2.5. To extend loan assistance to legitimate members through the salary loan assistance     program.

Article III

Membership

Section 1. All bonafide employees of BNHS are qualified to be members of the association regardless of term of status.

Section 2. Any member, who resigns or retires from the service, may retain membership together with the rights and duties on condition that annual dues and all authorized financial obligations as required by the association shall be paid.

Section 3. Membership of the association shall be terminated on any of the following grounds:

            3.1. Non – payment of the annual dues and authorized financial obligations for the period of six (6) months.

            3.2. Disloyalty of the association as determined by the adjudicating committee.

            3.3. Culpable violation of the Constitution and By-Laws and majority decisions of the association.

Section 4. Reactivation to the association may be allowed provided that he/she pays arrears and surcharges of the unpaid obligations.

Article IV

Rights, Duties and Responsibilities of Members

Section 1.Every legitimate member has the right to access records, pertinent information and documents of the Association.

Section 2.Every legitimate member has the right to an equal treatment protection and opportunity regardless of sex, status and religion.

Section 3.Every legitimate member has the right to be informed with regard to any activity of the Association.

Section 4.Every legitimate member has the right to be heard and seek just and partial redress of grievances relative to discharge of duties and responsibilities of a member of the Association as determined by the Adjudicating Committee.

Section 5.It shall be the duty of legitimate member to be loyal to the association, uphold its Constitution and By-Laws, to obey its laws and to cooperate with its officers in order to attain its aspirations.

Section 6.It shall be the duty of legitimate member to vote and to be elected in any office of the association, thus, it shall not be elected in absentia.

Section 7.It shall be the duty of legitimate member to pay a membership fee of One Thousand Pesos (1,000.00 Php) upon admission, an annual due of Five Hundred Pesos (500.00 Php), and other financial obligations agreed upon by the body.

Section 8.It shall be the duty of legitimate member to give financial assistance of One Thousand Pesos(1,000.00 Php) to beneficiaries of legitimate member and Five Hundred Pesos (500.00 Php) to immediate family member in times of death and hospital assistance of Three Thousand Pesos (3,000.00 Php) coming from the members regardless to the number of times a member be hospitalized due to major operation or confinement of a minimum of Seventy Two (72) hours.

Section 9.It shall be the duty of every member to observe professional ethics and to safeguard the integrity of the association. Transparencies should always be observed.

Section 10.It shall be the duty of every member to join all activities sponsored by the association.

Article V

Funds and Utilization

 Section 1.General fund: The general fund of the association shall consist of funds derived from:

  1. Trust Fund

1.1.1. Membership Fee               – 1,000.00 Php 

1.1.2. Annual Dues                                –     500.00 Php

1.1.3. Interest of deposits

1.1.4. Surcharges or Arrears

           1.2. Loanable Fund

                1.2.1. Loan interest and services fee

           1.3. Services Fund

                1.3.1. Sales on school supplies

                    1.3.2. Income from IGP ( xerox, printing of t-shirts)

                1.3.3. Fines from members (late, absenteeism, not wearing of proper uniform)

                       1.3.3.1 Late – Twenty Five Pesos (25.00 Php)

                       1.3.3.2 Absent – Two Hundred Pesos (200.00 Php)

                       1.3.3.3 Improper Uniform – Fifty Pesos (50.00 Php)

           1.4. Financial Assistance Fund

Section2.Operational Fund: There shall be fund for operational expenses recommended by the Ways and Means committee for officers’ deliberation and approved by the assembly.

Article VI

Officers of the Association, Tenure and Duties

Section1.The administrative term shall be (2) two terms starting every first Monday of July in every school year.

Section 2.The Executive Officers of the Association shall be President, Vice-President, Secretary, Treasurer, Auditor, Business Manager, Public Information Officer and Adviser.

Section 3.The tenure of the Executive officers shall be a period of Three (3) years.

Section 4.The duties of the officers are;

           4.1. President: The President shall request and preside over the executive meetings and other special meetings relative to the operations and concerns of the association.

                 4.1.1. Submit a general report about the association at the end of his/her term.

                4.1.2. Perform all the inherent, implied, and expressed duties pertaining to the position and for which no liability shall be incurred as a consequence of the exercise on honest judgment of discretion in relation thereto.

           4.2. Vice-president: The Vice-president shall perform the duties of the President in case of physical absence and inability to perform his duties due to reasonable cause.

                  4.2.1Shall assumes other duties that are delegated by the President or school authorities.

           4.3. Secretary: The secretary shall keep all records of the association proceedings. It shall be the duty of the secretary to:

                           4.3.1. Keep minutes of all meetings and special meetings of the association.

                           4.3.2. Prepare and handle all official correspondence of the association to every members.

                  4.3.3. Turn over all pertinent files and records of the association to the in-coming        secretary at the completion of his/her term.

           4.4. Treasurer: The Treasurer shall perform all official financial transactions of the   association. It shall be the duty of the treasurer to:

               4.4.1. Custodian of all the association properties and funds.

               4.4.2. Collect and receive fees of dues, contributions by every member as agreed

           upon by the members.

               4.4.3. Disburse funds in accordance with financial procedure promulgated by the officers and approved by the members.

               4.4.4. Submit a certified and detailed statement of collections and disbursement done in the ensuing school year which begins on May 01 and terminates on April 30 of the following year.

               4.4.5. Render accounting of all association funds and properties every end of the school year.

               4.4.6. Certify the availability of funds whenever required by the officers.

           4.5. Auditor: The Auditor shall protect the fiscal interest of the association. It shall be the duty of the Auditor to:

               4.5.1. Periodically inspect the Book of Accounts of the association and duty to bound and to bring attention of the President/Adviser any irregularities/discrepancies observed therein.

               4.5.2. Audit all disbursement of funds and annual financial reports of the treasurer.

           4.6. Business Manager: The Business Manager shall assist the President in all the business activities of the association in relation to the accomplishments, projects, and perform other duties assigned to him/her by the association President.

           4.7. Public Information Officer: The P.I.O. shall coordinate and act as the Association Liaison to the Community as well as other organization and shall initiate setting up a newsletter for the association.

           4.8. Adviser: The Adviser shall extend his/her experience and wisdom to the President during meeting and other activities and share insights when deemed necessary. He/She is ex-officio member of the Audit Committee.

           4.9. When a vacancy arises due to resignation or inability to perform duties and responsibilities and where no succession is provided in the Constitution and By-Laws, The President, with the concurrence of the Adviser shall appoint any member to fill such vacancy until the next election.

Article VII

Special Committees

Section 1.There shall be six (6) committees whose chairpersons shall be headed by the  officer and shall appoint two members to his/her committee. Each chairperson shall report from time- to- time during monthly meetings and render annual report during the general assembly meeting. The President/Adviser will automatically an ex-officio member in every standing committee.

  1. The Finance Committee- shall prepare the annual budget of the association and ways and means to improve the financial status of the association.
    1. The Audit Committee- shall be responsible for auditing the Treasure’s accounts and present a report during the general meeting.
    1. The Scholarship and Educational Programs Committee- shall be responsible in setting the criteria for scholarship and educational program awards and in the selection of recipients.
    1. The Social Welfare Committee- shall take charge of the just and equal distribution of fringe benefits due to the members of the association.
    1. The election Committee- shall manage the election procedure of the association.
    1. The Adjudicating Committee- shall seek redress grievance of any member in relation to their duties and responsibilities and shall recommend findings to the school authorities.

Article VIII

Meeting and Quorum

Section 1.The Association shall meet at least once a month integrated during faculty meeting, special meeting may be called by the President if deemed necessary.

Section 2.The annual general meeting shall be every end of every school year.

Section 3.In the meeting of association, a majority vote of all legitimate members present shall validate the business transaction. Voting by proxy is not allowed. The presiding officer shall be the sole arbiter in matters and procedures. If a conflict cannot be resolved, the majority decision of the assembly shall prevail.

Article IX

Amendments

Section 1.These By-Laws may be amended in response to changes on the felt needs of the association by the majority votes of the members of the association in a regular meeting called for.

Section 2.Ammendments to these By-Laws shall take effect upon deliberation and approval by the majority.

Article X

Effectivity

Section1. This Constitution and By-Laws shall take effect immediately upon ratification by all the legitimate members.
